What this statement is about

Angle Finance is a specialist commercial financial services provider. This statement explains how we collect, hold, use and disclose Personal Information and Credit Information about individuals (including applicants, directors and guarantors), and how you can access and correct your information or make a complaint.

Key definitions

Personal Information means information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether true or not, and whether recorded in material form or not.

Credit Information means personal information about an individual (other than sensitive information) regulated under Part IIIA of the Privacy Act, including information obtained from credit reporting bodies, information about applications for credit, repayment history information, default information, and serious credit infringement information (as applicable).

What information we collect

The kinds of Personal Information and Credit Information we may collect include:

  • identity and contact details (name, date of birth, residential address, phone number, email address);
  • identification documents and details (including copies/images of documents such as driver licences, passports and Medicare cards, and information contained in those documents);
  • financial and employment information relevant to assessing and administering finance (income, expenses, assets, liabilities and supporting documents);
  • application and account information, including communications and interactions with us;
  • credit-related information, including credit reports, repayment history information and default information, where permitted; and
  • verification and fraud-related information, including identity verification results, DVS check outcomes and risk indicators.

We generally do not collect sensitive information unless required or permitted by law, or with your consent.

How we collect information

We may collect information:

  • directly from you (including via applications, emails, phone calls, portal interactions and documents you provide); and
  • from third parties, including finance brokers, retailers/dealers/introducers, employers (where relevant), other financiers, publicly available sources, identity verification providers, credit reporting bodies and other credit providers (where permitted).

If you do not provide information we request, we may be unable to verify your identity, assess your application, provide finance, or comply with legal and regulatory requirements.

Why we collect, hold, use and disclose information

We collect, hold, use and disclose Personal Information and Credit Information where reasonably necessary to:

  • assess and process applications for finance and related services;
  • verify your identity and carry out customer due diligence;
  • comply with obligations under the Anti‑Money Laundering and Counter‑Terrorism Financing Act 2006 (Cth) and AML/CTF Rules;
  • administer, manage and enforce finance products and agreements;
  • obtain and exchange credit information with credit reporting bodies and other credit providers (where permitted);
  • detect, prevent and investigate fraud, identity theft and other financial crime (including ongoing fraud monitoring);
  • manage risk, internal operations, complaints and disputes;
  • comply with legal and regulatory obligations; and
  • (unless you opt out) provide you with information about products and services that may be of interest to you.

Identity verification (including the Australian Government DVS)

We may verify identity using electronic verification systems, including the Australian Government Document Verification Service (DVS). We access the DVS through accredited information match service providers (including Equifax and GreenID or their successors).

For these checks, we may disclose certain information from your identity documents (for example, document numbers and identity details) to the relevant service provider and the DVS. The DVS returns a verification result (for example, match/no match).

Retention of identification documents and verification records

We may retain copies/images of identification documents and identity verification outcomes where reasonably necessary to:

  • comply with legal and regulatory obligations;
  • detect, prevent and investigate fraud and other financial crime (including ongoing monitoring);
  • manage disputes and enforce our rights; and
  • meet record-keeping and governance requirements.

As a baseline, we generally retain relevant records for the life of the loan (or relevant relationship) plus 7 years, subject to legal requirements, fraud risk considerations and applicable limitation periods.

We take reasonable steps to protect information we hold from misuse, interference and loss, and unauthorised access, modification or disclosure.

Who we disclose information to

We may disclose Personal Information and Credit Information to:

  • our related bodies corporate;
  • finance brokers, retailers/dealers/introducers and aggregators;
  • credit reporting bodies and other credit providers;
  • identity verification and fraud prevention providers (including information match service providers);
  • professional advisers (including legal, accounting and audit);
  • contractors and service providers (including IT, hosting, data storage and operational support providers);
  • corporate funders, securitisation participants and prospective purchasers of our business; and
  • law enforcement, regulators, courts and dispute resolution schemes, where required or authorised by law.

Overseas disclosures

Some service providers who support our systems and operations may be located overseas or may access information from overseas. At present, we may disclose or permit access to information by service providers located in the Philippines (and potentially other jurisdictions where our providers operate).

Where we disclose information overseas, we take reasonable steps to ensure the overseas recipient handles the information in a manner consistent with the Australian Privacy Principles, or as otherwise required or permitted by law. You acknowledge that privacy protections and remedies may differ in overseas jurisdictions.

Direct marketing

We may use your Personal Information to send you information about products and services that may be of interest to you.

You can opt out at any time by contacting us at enquiries@anglefinance.com.au or using the unsubscribe facility included in our messages. Opting out will not affect our ability to provide products or services (other than marketing communications).

Credit reporting

As a credit provider, we may handle credit information in accordance with Part IIIA of the Privacy Act and the Credit Reporting Privacy Code.

We may obtain and exchange credit information (including credit reports) for purposes such as:

  • assessing applications for credit;
  • assessing guarantors (including obtaining credit reports on all guarantors, and on directors when they are a guarantor);
  • managing and administering credit;
  • collecting overdue payments;
  • assisting you to avoid default; and
  • detecting and dealing with fraud or serious credit infringements.

You may request a credit reporting body:

  • not to use your credit information for pre-screening of direct marketing; and/or
  • not to use or disclose your credit information if you believe on reasonable grounds that you have been, or are likely to be, a victim of fraud (a “ban period”).

Access and correction

You may request access to the Personal Information and Credit Information we hold about you and request correction if it is inaccurate, out of date, incomplete, irrelevant or misleading.
